Terms and Conditions

1. Provider

These Terms and Conditions govern the provision of tourism services offered by Green Trails S.A.S. (“Green Trails”, “we” or “the operator”), a Colombian licensed tour operator with main offices at AC 100 # 17A-36, Bogotá D.C., Colombia, registered with the Colombian National Tourism Registry under RNT 63720 and IATA 96224424. 2. Scope

Green Trails is a tour operator authorised under Colombian Law 300 of 1996 and its regulations, dedicated to the design, sale and operation of private tours, multi-day packages, tailor-made trips, private ground transport and corporate & incentive travel (MICE) within Colombia.

3. Acceptance

Using greentrails.co or booking any service constitutes full acceptance of these Terms and of our Personal Data Protection Policy.

4. Definitions

• User or Traveller: any individual or legal entity that requests a quote or books a service.
• Tourism services: tours, transfers, private transport, packages, accommodation, guides, activities and any other service offered directly by Green Trails or through partner suppliers.
• Supplier: third party (hotels, airlines, restaurants, parks, local operators, etc.) whose services are intermediated or bundled by Green Trails.

5. Quotation and reservation

Quotations are valid for a maximum of fourteen (14) calendar days unless otherwise stated. Rates may change without notice due to supplier availability, currency fluctuations, taxes or fees. A reservation is confirmed only when Green Trails issues a written confirmation and the initial payment is received.

6. Rates, payments and deposits

Unless otherwise agreed in writing:

• Private tours: 10% deposit to confirm, 90% balance before the tour starts.
• Multi-day packages: 30% deposit on confirmation, balance no later than thirty (30) days before the trip starts.
• Private transport: per the conditions of the specific quote.
• Payments may be made via bank transfer, payment gateway or credit/debit card, in Colombian pesos (COP) or, where applicable, US dollars (USD) at the agreed rate.
• Prices include applicable Colombian taxes unless stated otherwise. Non-resident foreign travellers may qualify for VAT exclusion on hotel services where legal requirements are met.

7. Changes and cancellations

Cancellations initiated by the user follow this general scale, subject to stricter conditions imposed by suppliers (non-refundable hotels, flight tickets, events, peak season):

• More than 30 days before the service: 90% refund of amounts paid.
• Between 30 and 15 days: 50% refund.
• Between 14 and 7 days: 25% refund.
• Less than 7 days or no-show: no refund.

Under article 47 of the Colombian Consumer Statute (Law 1480 of 2011), the right of withdrawal does not apply to services whose execution has begun or that are tied to specific dates, which is the nature of tourism services.

Green Trails may modify or cancel a service due to force majeure, adverse weather, public-order disturbances, authority decisions or safety reasons, and will offer rescheduling, a comparable alternative or a refund of the amounts effectively received, net of non-recoverable third-party costs.

8. Liability

Green Trails is liable for the proper organisation and direct provision of its services. When intermediating third-party services (hotels, airlines, cruise lines, local operators, restaurants, theme parks, etc.), Green Trails acts solely as an intermediary, and the supplier is responsible for the actual provision under its own terms.

Green Trails shall not be liable for damages arising from: (i) inaccurate or incomplete information provided by the traveller; (ii) failure to comply with immigration, health or customs requirements; (iii) events of force majeure; (iv) actions or omissions of third parties outside the operator’s control; (v) the traveller’s own conduct contrary to the law or to the instructions of the guide or driver.

9. Traveller obligations

• Provide accurate and complete information when requesting a quote or booking.
• Hold a valid ID or passport, visas, vaccines and any other requirements demanded by the destination authorities.
• Arrive at meeting points with the indicated lead time and respect itinerary times.
• Follow safety instructions from the guide, driver or authorised staff.
• Purchase, at their sole responsibility, any medical assistance or travel insurance they deem appropriate.

10. Insurance and medical assistance

Unless expressly included, rates do not cover travel insurance, international medical assistance or cancellation coverage. We strongly recommend purchasing an adequate policy before the service begins.

11. Child protection

Green Trails complies with Colombian Law 679 of 2001, Law 1336 of 2009 and Decree 1069 of 2014, and categorically rejects any form of commercial sexual exploitation of children and adolescents (ESCNNA) associated with travel and tourism. Violations will be reported immediately to the competent authorities.

12. Anti-money-laundering

In compliance with Law 526 of 1999, UIAF circulars and MinCIT resolutions for the tourism sector, Green Trails may request additional documentation to verify the customer’s identity and source of funds, and may report unusual or suspicious operations.

13. Intellectual property

All site content (text, images, videos, logos, trademarks, itineraries, designs) is owned by Green Trails or its licensors and is protected by copyright and industrial property laws. Reproduction, distribution or commercial use without prior written authorisation is prohibited.

14. Requests, complaints and claims

Any request, complaint or claim may be sent to bookings@greentrails.co or in writing to the physical address above. Green Trails will respond within the timeframes set by Colombian law and, in any case, within fifteen (15) business days.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Disputes will be submitted to the competent courts of Bogotá D.C., without prejudice to consumer actions before the Superintendence of Industry and Commerce (SIC) under Law 1480 of 2011.

16. Changes

Green Trails may amend these Terms at any time. The version in force is the one published on the website with its update date.
